These Terms and Conditions and Privacy Policy explain how YogFitAI provides its fitness, yoga, AI workout tracking, health summary, rewards, and account features, and how we collect, use, disclose, protect, retain, and delete information. By creating an account, accepting these terms, or using the app, you agree to this policy. If you do not agree, do not use the app.

YogFitAI is a fitness and wellness application. It is not a medical device and does not provide medical advice, diagnosis, treatment, emergency services, or clinical recommendations. AI pose and workout analysis may be inaccurate or incomplete. Always consult a qualified medical professional before starting or changing an exercise, yoga, diet, or wellness program, especially if you have a medical condition, injury, pregnancy, disability, or other health concern. Stop exercising immediately if you feel pain, dizziness, shortness of breath, or discomfort.

Physical activity involves risk, including injury. You are responsible for choosing activities suitable for your body, environment, equipment, and fitness level. You agree that you use YogFitAI voluntarily and at your own risk. YogFitAI is not responsible for injuries, losses, or damages caused by unsafe movement, incorrect form, unsuitable exercise selection, device issues, inaccurate sensor data, or failure to follow safety guidance.

We may collect account and profile information such as full name, email address, phone number, gender, date of birth, age-related information, height, weight, profile picture/avatar, subscription plan, support messages, app settings, and terms acceptance status. We may collect workout and wellness information such as selected exercises or yoga poses, session duration, repetitions, calories, daily summaries, rewards, and progress. Where you enable integrations, we may access health and fitness information from Google Health Connect, Google Fit, or similar services, such as steps, calories, distance, heart rate, sleep, weight, and workout records. We may collect technical information such as device type, app version, diagnostics, crash logs, IP address, authentication tokens, and usage events needed for security, analytics, and app operation.

YogFitAI uses the device camera for AI-assisted movement tracking only when you start a workout or yoga session and grant permission. Camera pose detection is designed and intended to run locally on device. We do not intentionally record, store, or transmit raw camera video feeds to external servers. Derived workout metrics, session summaries, pose analysis outputs, or configuration data may be stored to provide tracking, progress, rewards, and app features.

Health data is used exclusively to provide user-requested health, fitness, yoga, workout, progress, calorie, reward, and daily summary features. We do not sell, rent, or share your personal health data with advertisers, data brokers, information resellers, marketing partners, or other third parties for their own independent use. We do not use Google Health Connect data for targeted advertising. Health data may be processed by YogFitAI systems and carefully selected technical service providers acting on our behalf only where necessary to operate, secure, sync, store, or support the app. You can revoke health permissions through your device settings at any time.

Under the EU General Data Protection Regulation (GDPR), we process your data under the following legal bases: (a) Explicit Consent (Art. 9(2)(a)) for Special Category Health Data (e.g., heart rate, steps, active energy expenditure, pose telemetry); (b) Performance of Contract (Art. 6(1)(b)) to provide requested AI workout and account features; (c) Legitimate Interests (Art. 6(1)(f)) for app security, fraud prevention, diagnostic telemetry, and service performance improvement; and (d) Compliance with Legal Obligations (Art. 6(1)(c)). You may withdraw consent at any time without affecting the lawfulness of prior processing.

For users residing in India, YogFitAI acts as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 (DPDP Act). We process personal data only for specified lawful purposes with your consent or for legitimate uses defined by law. In accordance with Section 14 of the DPDP Act, Indian users have the Right to Nominate any individual to exercise data protection rights on their behalf in the event of death or incapacity. You may exercise your rights to access, correct, complete, update, or erase personal data by contacting our Grievance Redressal Officer at yogfitai@gmail.com.

We use information to create and manage your account, authenticate users, provide workouts and yoga practices, personalize app experience, calculate metrics, sync health summaries, process rewards, manage subscriptions, provide customer support, detect abuse or security issues, debug and improve the app, comply with legal obligations, and communicate important service updates. We may use aggregated, anonymized, or de-identified information for analytics, product improvement, research, business planning, reporting, and commercial insights, provided it does not identify you.

Where permitted by applicable law and store rules, we may use or disclose limited non-health account, contact, profile, device, and usage information to service providers, affiliates, analytics providers, and infrastructure partners for app operations, measurement, fraud prevention, business development, and app improvement. We strictly require such parties to protect user information appropriately. We never use personal health data for advertising or marketing purposes.

Depending on your jurisdiction (e.g., GDPR, CCPA/CPRA, DPDP Act 2023), you have the following rights: (a) Right of Access & Data Portability: Request a copy of your personal data in a structured, machine-readable format (JSON); (b) Right to Erasure / Account Deletion: Request permanent purge of your account and records; (c) Right to Rectification: Correct inaccurate data; (d) Right to Restrict or Object: Object to processing based on legitimate interests; and (e) Right to Non-Discrimination for exercising your privacy rights. We implement administrative, technical, and physical safeguards designed to protect personal information, including SSL/TLS encryption in transit, encrypted database storage at rest, restricted access controls, and multi-factor authentication. In the event of a confirmed personal data breach or cybersecurity incident impacting your data, YogFitAI maintains a strict response protocol: we will notify affected users and supervisory authorities (including the Data Protection Board of India / CERT-In within 6 hours where mandated, and relevant EU supervisory authorities within 72 hours under GDPR Art. 33) without undue delay following confirmation of the incident.

Personal data collected by YogFitAI may be stored and processed in secure cloud infrastructure (e.g., Google Cloud Platform / Firebase) located in global data centers. For transfers of European or UK data outside the EEA/UK, we implement appropriate safeguards such as Standard Contractual Clauses (SCCs) approved by the European Commission, combined with technical encryption standards, ensuring your data receives an equivalent level of protection regardless of location.

We retain personal information for as long as needed to provide the app, maintain your account, comply with legal obligations, resolve disputes, enforce agreements, and maintain security. You may deactivate or delete your account inside the app under Profile > Settings > Legal Information > Delete Account or request deletion via our web portal. Deletion permanently removes or anonymizes account details, workout history, rewards, and health summaries, subject to statutory backup and fraud prevention limits.

YogFitAI is strictly not intended for children under 13 years of age (or under 18 in India under DPDP Act 2023 without verifiable parental consent). We do not knowingly collect or track personal information from minors. If you believe a child has provided us with personal data, contact us immediately for prompt deletion.

Under GDPR Art. 22 and applicable global regulations, YogFitAI clarifies that camera-based AI pose tracking, repetition counting, form accuracy scores, and workout summaries are automated analytical tools designed for personal exercise assistance only. They do not constitute automated decision-making producing legal or similarly significant effects on users.

You agree not to misuse the app, attempt unauthorized access, interfere with app security, submit false or misleading information, reverse engineer restricted parts of the service, or violate applicable law. We reserve the right to suspend or terminate accounts violating these rules.

Certain features may depend on subscription plan, device compatibility, internet access, health integrations, or backend availability. Rewards, EnerCoins, and activity summaries are app features only and may be adjusted or suspended in cases of system error, abuse, or fraud.

We may update these Terms and Privacy Policy from time to time to reflect statutory or technical changes. If changes are material, we will provide notice in the app or via email. Continued use of YogFitAI following notice indicates acceptance of the updated policy.
